Acceptance Of Terms And Conditions

By purchasing any Vendor Offers, Product or participating in other available programs via the Mobile Application, you agree to the Terms of Use, including, without limitation, the Terms of Sale specified hereinbelow. These Terms of Sale form part of the overall Terms of Use of the Mobile Application and are to be read in consonance with them.

These rules apply unless otherwise stated in the fine print pertaining to the Offer:

Vouchers/Offers/Coupons will expire on the date specified on it.
Cannot be combined with other offers.
Providing voucher code is mandatory to avail offer.
Must be redeemed in a single visit (unless specified otherwise).
Vouchers can be redeemed only after due verification of the Customer (including Photo ID Proof, if required).
All local/national laws and rules, consumption of intoxicants etc. that apply to regular customers, apply to Aapdu Bazaar voucher holders too.
The vendor is solely responsible for the taxes levied/to be levied on the services/ products for providing the Sales Invoice to the Customer against the services rendered or product sold.
In case of cancellation or transactional failure, Promo Codes shall not be valid for cash back.

Health/Medical/Surgical Services and other Offers:

Given the nature of these Offers, Aapdu Bazaar does not take responsibility for any medical complications that arise during or post the treatment. We strongly advise our Users to take all necessary precautions/consultations before availing this Offer.

Purchase and Redemption of Aapdu Bazaar Vouchers:

Descriptions of the Vendor Offers and Products/Services listed on the Mobile Application are provided by the Vendor or other referenced third parties. Aapdu Bazaar is not responsible for any claims associated with the description of the Vendor Offers or Products. Pricing relating to certain Vendor Offers, Products/Services, and other available programs on the Mobile Application may change at any time in Aapdu Bazaar’s sole discretion without notice. Thus, it is advisable to go through the policies before making any purchase or redemption on our Mobile Application.
A Vendor may list goods, services or experiences on the Mobile Application, or with respect to Products or Services, that require Vendor to have an up-to-date regulatory authorization, license, approval or certification. Aapdu Bazaar does not verify, validate, or collect evidence of any regulatory authorization, license or certification from any Vendor (including but not limited to Health & Fitness and Beauty & Spa Vendors and At Home Services), of which sole responsibility shall be of the Vendor at all times and shall be governed by the separate Terms and Conditions agreed between the Vendor and Aapdu Bazaar that may be subject to change from time to time.
Aapdu Bazaar is not a health or wellness provider and does not, will not and cannot refer, recommend or endorse any specific professional, services, products or procedures that are advertised on the Mobile Application. The Mobile Application is not a substitute for professional advice, including, without limitation, medical advice, diagnosis or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a health condition. Never neglect to seek out or delay or disregard professional advice relating to your health because of something you have read on the Mobile Application.
Aapdu Bazaar may, in its sole discretion, verify a User’s identity prior to processing a purchase. Aapdu Bazaar may also refuse to process a purchase, may cancel a purchase, or may limit quantities, as reasonably deemed necessary, to comply with applicable law or to respond to a case of misrepresentation, fraud or known or potential violations of the law or these Terms of Sale. Refunds for canceled orders may be issued where appropriate.
If an offer becomes unavailable between ordering and processing, Aapdu Bazaar will either cancel or not process the order and may notify you by SMS/Notification accordingly. Refund shall be processed by the original mode of payment as was used while ordering or booking by the Customer.
Aapdu Bazaar does not guarantee that it offers best available prices and does not guarantee against pricing errors. Aapdu Bazaar reserves the right, in its sole discretion, to not process or to cancel any orders placed, including, without limitation, if the price was incorrectly made available on the Mobile Application. If this occurs, Aapdu Bazaar may attempt to notify you by SMS/notification. In addition, Aapdu Bazaar reserves the right, in its sole discretion, to correct any error in the stated retail price of the Vendor Offers or Product/Services as agreed and provided by the Vendor.

The Aapdu Bazaar Mobile Application is an intermediary (Platform) which facilitates promotion of various Offers offered by Vendors, on their respective services and products by way of offering vouchers.

Vouchers:

Voucher means an instrument, in either physical or electronic form, present in the form of alphanumeric code/QR code containing the terms of the Offers/Deal which entitles the holder of such Voucher (the “Voucher Holder”) to receive the Vendor Offers from the Vendors of Aapdu Bazaar, to be used on or before the use by date stated on the Voucher (the “Voucher Expiry Date”).
The Vendor Offers shall mean the products and/or services to be provided by the Vendor to the respective Voucher Holder, as specified on Aapdu Bazaar’s Mobile Application and the Voucher.
The Vendor is a third party unrelated to Aapdu Bazaar that sells, supplies and/or provides the Vendor Offers on Aapdu Bazaar Mobile Application. Aapdu Bazaar displays the Vendor Offers on Aapdu Bazaar Mobile Application and acts as a collection agent for the Vendor for Vendor Offers on the Aapdu Bazaar Mobile Application. Once a User makes a purchase of the Vendor Offer on Aapdu Bazaar Mobile Application, Aapdu Bazaar provides User with a Voucher which will enable the User to avail the Vendor Offer.
Aapdu Bazaar is liable only when you purchase the Aapdu Bazaar Booklet and not for any other vendor offers.
In order to purchase and redeem Aapdu Bazaar Vouchers, the User shall be required to create an account on the Aapdu Bazaar Mobile Application. This is required so that we can provide you with easy access to your orders or view your past purchases.
By making a purchase and/or redemption of Vendor Offer listed on the Mobile Application, you get an Aapdu Bazaar Voucher which enables you to avail the Vendor Offer which you have selected based on Aapdu Bazaar’s Standard Terms of Use and Conditions, institution-specific restrictions and on these Terms of Sale.
When you go through the procedure for purchasing a Voucher, you are required to accept these Terms of Sale before making payment. Once Aapdu Bazaar has received the amount due from the Customer for Vendor offer (by Debit Card or Credit Card or Net Banking or UPI or other acceptable modes of payment) the transaction is considered complete, and a contract for purchase is made, and at this stage, Aapdu Bazaar will send an SMS to you confirming the transaction (which is our acceptance of the transaction). We keep a copy of the contract with us. You are welcome to save these Terms of Use and Terms of Sale from our App as a record.
All Aapdu Bazaar Vouchers shall be subject to the standard terms and conditions and specific terms and conditions (as mentioned on the Offer). Aapdu Bazaar Vouchers are issued on behalf of the Vendors and only such Vendors, to the exclusion of Aapdu Bazaar, shall be responsible for any and all injuries, illnesses, damages, charges, expenses, claims, liabilities and costs suffered by or in respect of a Customer, caused in whole or in part by the Vendors or which arises out of the products and/or services provided by the Vendors, as well as for any unclaimed property liability arising from unredeemed Aapdu Bazaar Vouchers.
As a condition of purchase, we reserve the right to send you administrative and promotional emails/SMS. We may also send you information regarding your purchases, as well as updates about the Mobile Application and Service and Vouchers as well as other promotional offers. You can opt out of our promotional emails/SMS anytime by clicking the unsubscribe link at the bottom of any of our email correspondences.
Any purchase of a Voucher is for your non-commercial, personal use only (although you may give the Voucher to someone else for their non-commercial, personal use).
You promise not to provide false data including false names, addresses and/or contact or payment details; or engage in any unlawful activity in connection with the purchase or use of a Voucher, or allow/encourage anyone else to do so.
Any attempt to redeem a Voucher contrary to these Terms of Sale may render a Voucher void at Aapdu Bazaar’s discretion.
The reproduction of a Voucher is strictly prohibited.
The commercial trade of a Voucher is strictly prohibited.

Standard Terms and Conditions (applicable for Restaurant Services offered through Aapdu Bazaar Vouchers):

For the purposes of this section, ‘Restaurant’ shall be defined as an Institution that offers food and beverages for sale in its regular business operations, and is making such food and beverages available to purchasers of Aapdu Bazaar Vouchers. In this respect, the following shall constitute as ‘Standard Terms and Conditions’ for redeeming Aapdu Bazaar Vouchers:

Aapdu Bazaar shall not be responsible for the quality of services provided by the Restaurant, and the same shall be the sole responsibility of the Restaurant.
Aapdu Bazaar Vouchers are redeemable in their entirety only and may not be redeemed partially or incrementally.
Aapdu Bazaar Vouchers can be redeemed only after due verification of the customer including, without limitation, matching the unique identification code provided to the customer at the time of purchase of Aapdu Bazaar Vouchers.
“Voucher expiry date” shall be mentioned on Aapdu Bazaar Vouchers for your reference.
It is at the discretion of the Restaurant to determine whether Aapdu Bazaar Vouchers can be combined with any other Restaurant vouchers, third party vouchers, coupons, or promotions and the like.
Aapdu Bazaar Vouchers cannot be used for taxes, tips or prior balances, unless permitted by the Restaurant.
Aapdu Bazaar Vouchers are valid for dine-in only unless otherwise stated.
The issuing of restaurant credit is at the sole discretion of the Restaurant.
Neither Aapdu Bazaar nor the Restaurant is responsible for lost or stolen Vouchers or the reference numbers mentioned on it.
Reproduction, sale or trade of Aapdu Bazaar Vouchers is strictly prohibited.
Any attempted redemption not consistent with these Terms of Use, Standard Terms & Conditions and Specific Terms & Conditions mentioned on the Voucher will render the Aapdu Bazaar Voucher void and invalid.
Aapdu Bazaar Voucher (including, but not limited to, any discounts provided therein) will expire on the date specified on it, and you will not be able to avail the service from the Vendor after this date.

Restaurants for which the Offers are availed by you will have their own applicable terms and conditions, in relation to their own supply of their products and services, and you agree to (and shall) abide and adhere to those terms and conditions. The responsibility to do so is yours alone.

Standard Terms and Conditions (applicable for Non-Restaurant Services offered through Aapdu Bazaar Vouchers):

The following shall constitute as ‘Standard Terms and Conditions’ for redeeming Aapdu Bazaar Vouchers for purchasing Vendor’s products and/or services from Institutions other than Restaurants:

Aapdu Bazaar shall not be responsible for the quality of products and/or services provided by the Institution, and the same shall be the sole responsibility of the Institution/Vendor.
Aapdu Bazaar Vouchers are redeemable in their entirety only and may not be redeemed incrementally.
Aapdu Bazaar Vouchers can be redeemed only after due verification of the Customer including, without limitation, matching the unique identification code provided to the Customer at the time of purchase of Aapdu Bazaar Vouchers.
Limit One (1) Voucher per redemption. Only one Voucher can be used per visit unless otherwise provided in the Specific Terms & Conditions of the Voucher or as specified by the Institution/Vendor.
Neither Aapdu Bazaar nor the Institution is responsible for lost or stolen Vouchers or the reference number mentioned on it. Aapdu Bazaar Vouchers cannot be combined with any other gift vouchers, third party vouchers, coupons, or promotions, unless otherwise specified by the Institution.
Reproduction, sale or trade of Aapdu Bazaar Vouchers is strictly prohibited.
Any attempted redemption not consistent with these terms and conditions will render the Aapdu Bazaar Voucher void and invalid.

Institutions/Vendors will have their own applicable terms and conditions, in relation to their own supply of their products and services, and you agree to (and shall) abide and adhere to those terms and conditions. The responsibility to do so is yours alone.

While using Aapdu Bazaar Mobile Application, User shall not:

Post content or items in any inappropriate category or areas on the Mobile Application
Violate any laws, third-party rights, Account Policies, or any provision of the Terms of Use, such as the prohibitions described above
Fail to deliver payment for Services purchased by you, unless the Vendor or the Individual has materially changed the description of the Service description after you negotiate an agreement for such Service, a clear typographical error is made, or you cannot authenticate the individual(s)/personal identity
Fail to perform Services purchased from you, unless the Service User fails to materially meet the terms of the mutually agreed upon agreement for the Services, refuses to pay, a clear typographical error is made, or you cannot authenticate the Service User’s identity
Manipulate the price of any Service or interfere with other users’ Postings
Circumvent or manipulate our fee structure, the billing process, or fees owed to Aapdu Bazaar;
Post false, inaccurate, misleading, defamatory, or libelous content (including personal information about any app user)

DISCLAIMER

You agree that your use of the mobile application shall be at your own risk. To the fullest extent permitted by law, and Aapdu Bazaar and its officers, managers, members, directors, employees, successors, assigns, subsidiaries, affiliates, service professionals, suppliers, vendors, individuals, onboarded individuals and agents disclaim all warranties, express, implied, statutory or otherwise, and make no warranties, representations, or guarantees in connection with this mobile application, the services offered on or through this mobile application, any data, materials, submitted content, relating to the quality, suitability, truth, accuracy or completeness of any information or material contained or presented on this mobile application, including without limitation the materials, data and submitted content of other users of this mobile application or other third parties.

Unless otherwise explicitly stated, to the maximum extent permitted by applicable law, this mobile application, the services offered on or through this app, data, materials, submitted content, and any information or material contained or presented on this mobile application is provided to you on an “as is,” “as available” and “where is” basis with no warranty of implied warranty of merchantability, fitness for a particular purpose, or non-infringement of third-party rights. Aapdu Bazaar does not provide any warranties against errors, mistakes, or inaccuracies of data, content, information, materials, substance of the app or submitted content, any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, any bugs, viruses, trojan horses, or the likes which may be transmitted to or through the app by any third party, any interruption or cessation of transmission to or from the mobile application, any defamatory, offensive, or illegal conduct of any third party or service user or service provider, or any loss or damage of any kind incurred as a result of the use of any data, content, information, materials, substance of the mobile application or submitted content posted, emailed, transmitted, or otherwise made available via the mobile application. Aapdu Bazaar does not endorse, warrant, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the mobile application or any hyperlinked site or featured in any banner or other advertisement. Aapdu Bazaar will not be a party to or in any way be responsible for monitoring any transaction between you and any party, including third party service professionals of products or services. As with the use of any product or service, and the publishing or posting of any material through any medium or in any environment, you should use your best judgment and exercise caution where appropriate.

In no event shall Aapdu Bazaar, or its respective officers, managers, members, directors, employees, successors, assigns, subsidiaries, affiliates, service professionals, suppliers, attorneys or agents, be liable to you for any direct, indirect, incidental, special, punitive, consequential or exemplary damages (including but not limited to loss of business, revenue, profits, use, data or other economic advantage) whatsoever resulting from any

access to or use of the app or any services offered by any service professionals or vendors or individuals via the mobile application, including services provided pursuant to an agreement formed independently of the mobile application, whether or not an agreement for service formed via the mobile application is in effect
errors, mistakes, or inaccuracies of data, marks, content, information, materials or substance of the mobile application or submitted content
any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein
any bugs, viruses, trojan horses, or the like which may be transmitted to or through the mobile application by any third party
any interruption or cessation of transmission to or from the mobile application
any errors or omissions in any data, content, information, materials or substance of the mobile application or submitted content
any failed negotiations for a service, any disputes that arise during or after the negotiation of a service or the formation of a contract for a service, or any other dispute that arises between users of the mobile application
any defamatory, offensive, or illegal conduct of any third party or service user or service professional or vendor or individual/personnel
any use of any data, marks, content, information, materials or substance of the app or submitted content posted, emailed, transmitted, or otherwise made available on or through the mobile application, whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not Aapdu Bazaar is advised of the possibility of such damages. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.

In no event shall the total, aggregate liability of Aapdu Bazaar, or any of the above-referenced respective parties, arising from or relating to the mobile application, and/or submitted content exceed the total amount of fees actually paid to Aapdu Bazaar by you hereunder. You hereby acknowledge and agree that Aapdu Bazaar shall not be liable for submitted content or the defamatory, offensive, or illegal conduct of any third party or service user or service provider or vendor or individual/personnel and that the risk of harm or damage from the foregoing rests entirely with you. You further acknowledge and agree that Aapdu Bazaar shall not be liable for any direct, indirect, incidental, special, punitive, consequential or exemplary damages (including but not limited to loss of business, revenue, profits, use, data or other economic advantage) whatsoever resulting from or relating to any contract between mobile application users entered into independently of the mobile application. The mobile application may contain links to third-party websites that are not owned or controlled by Aapdu Bazaar. Aapdu Bazaar does not have any control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites. In addition, Aapdu Bazaar will not and cannot censor or edit the content of any third-party site. By using the app, you expressly relieve Aapdu Bazaar from any and all liability arising from your use of any third party website. Accordingly, please be advised to read the terms and conditions and privacy policy of each third-party website that you visit, including those directed by the links contained on the mobile application. Neither Aapdu Bazaar nor you shall be liable to the other for any delay or failure in performance under the terms of use, other than payment obligations, arising out of a cause beyond its control and without its fault or negligence. Such causes may include, but are not limited to fires, floods, earthquakes, strikes, unavailability of necessary utilities, blackouts, acts of god, acts of declared or undeclared war, acts of regulatory agencies, or national disasters.

Redeeming your Credits

To check your Aapdu Bazaar Credits balance, check the ‘My Wallet’ page in the main Menu. If you have Aapdu Bazaar credits in your Aapdu Bazaar account, you can choose to apply the same at the time of completing your purchase with Aapdu Bazaar and your payment amount shall be accordingly reduced with the amount of available & applied credits. This is however, subject to the following exceptions:

Aapdu Bazaar Credits can be applied only to a qualifying Offer, i.e. an Offer, for payment of which, Aapdu Bazaar Credits can be applied.
Aapdu Bazaar may from time to time provide for Credits’ inapplicability or partial applicability or modify or disable the option to apply Aapdu Bazaar credits on certain Offers and the details of the same shall be provided on the Coupon Page.
You must complete your valid purchase of the qualifying Offer to avail the benefit of these credits.
Any voucher bought using Referral/Promotional Credits shall not be eligible for re-validation or refund.

General:

If an offer becomes unavailable between your booking and before redemption, Aapdu Bazaar will cancel your order and may notify you by email/SMS.
Refund for cancellation or otherwise will be processed by the original mode of payment as was used while ordering by the Customer or in the form of Aapdu Bazaar credits, as per the discretion of Aapdu Bazaar.
Any voucher bought using Referral/Promotional Credits shall not be eligible for re-validation or refund or cancellation.
Where an Offer is specified to be non-cancellable or non-refundable on the Coupon Page this Refund & Cancellation Policy shall not apply to such Offers.
